Sharia Law and the Qur'an: Islamic scholars approve of prepubescent sex with a child.

 
The lead to this article originated with JihadWatch but all of the material used here was verified from within the actual sources as identified. I am going to extra lengths to write about what may be a very controversial subject and have taken every precaution to present a factual background because in America, having sex with a child is one of the most deplorable acts imaginable. Before getting into the actual subject here are some references as to what a "Fatwa" is and how it applies to Sharia Law and the Qur'an.

The authoritative online encyclopedia Wikipedia defines a "Fatwa" as this: A fatwā (Arabic: فتوى‎; plural fatāwā Arabic: فتاوى‎) in the Islamic faith is a religious opinion concerning Islamic law issued by an Islamic scholar.

According to the authoritative Islamic web site Islamopedia Online a "fatwa" is a legal opinion issued by an Islamic scholar. This web site defines a "Fatwa" as follows:
Here you will find fatwas and opinions on contemporary social issues.  A fatwa is a religious "responsa" given by a religious authority or group of authorities who are commissioned to issue guiding legal opinions.  A fatwa can be a response to a question asked by an individual or a response to a contemporary societal concern.  Religious opinions may also be articulated by persons who do not hold formal credentials for issuing fatwas, and such opinions can still be influential because of the legitimacy of the religious authority or issuing body.
The web site Translating Jihad  has discovered that an Islamic scholar issued a Fatwa that answers the question about the permissibility of Muslims having sex with prepubescent girls. The subject is necessary because it has been found that some courts in America have begun to recognize that Muslims who hold a  strong belief in their faith and consider following the principles of Sharia Law as a higher authority than U.S. Civil Law have legal defenses against criminal charges brought against them.

Fatwa: "It Is Permissible to Have Sexual Intercourse with a Prepubescent Girl"

This is another fatwa from IslamOnline.net, which again is the sixth most popular Islamic website on the internet, according to Wikipedia. As the author of this fatwa points out, this ruling is entirely based on the Qur'an and the example of the prophet, who is considered the perfect example for Muslims in all ages. How many young girls have been and continue to be abused due to Muhammad's perverse actions in having sex with a nine-year-old, which now must be made permissible for all Muslims? Translating Jihad links their sources to the Islamic web site IslamOnline.net  that has the original Arabic text of this Fatwa. Rather than ask anyone to accept the word on faith that this is an accurate report, I used the online services of Google Translate to give me the English translation. Here is a screen shot of the Google Translate page. To use this feature all you need is to copy the foreign language text from the source and paste it into the translate box, then identify the source language. An alternative method using Google Language Tools is to copy the URL and paste it into the box marked Translate a web page then identify the language to translate.

Question: What is your opinion of the calls from more than one Islamic country to prohibit girls from marrying before the age of eighteen? Which is nearest to Islam--these calls or not specifying a certain age for marriage the nearest to Islam? Is it correct that Islamic scholars permit the father to marry off his young daughter (I mean, a child)?
Answer: In the name of God, praise to God, and prayers and peace be upon the prophet of God, etc.
Scholars very nearly agree that it is the right of the father to marry off his young, immature daughter. This is owing to his authority over her, for as he is responsible for directing her and providing for her, he is also responsible for doing what he believes is in her interest on the issue of marriage.
Ibn Qudama in al-Mughni said:  "No one but the father can compel a woman, or marry off a young girl, whether a grandfather or otherwise." This was spoken of by Malik, Abu-'Ubayd al-Thawri, and Ibn Abu-Layli. This was also spoken of by al-Shafi'i, except he said it of the grandfather, making him like the father, because he has the authority of a parent, including to compel her like the father.
Al-Hasan, 'Umar Ibn-'Abd-al-'Aziz, Tawus, Qatada, Ibn-Shirama, al-Awza'i, and Abu-Hanifa said: "No one but the father can marry off a young girl; but she has the choice if she has matured." All of them but Abu-Hanifa said: "None but the father can marry two children, for they have the choice if they have matured."
It is important for us to understand that it is not a duty for a father to give his young girl in marriage, but it is restricted to her best-interest. For it is not permissible unless he believes that her best-interest requires it, and God is his judge on that.

The Noble Qur'an has also mentioned the waiting period [i.e. for a divorced wife to remarry] for the wife who has not yet menstruated, saying: "And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated" [Qur'an 65:4]. Since this is not negated later, we can take from this verse that it is permissible to have sexual intercourse with a prepubescent girl. The Qur'an is not like the books of jurisprudence which mention what the implications of things are, even if they are prohibited. It is true that the prophet (PBUH) entered into a marriage contract with A'isha when she was six years old, however he did not have sex with her until she was nine years old, according to al-Bukhari. The original Arabic text is long and quite rambling and the Google Translation is not as good but the message is perfectly clear. Muslims are encouraged to follow the example of their Prophet Muhammad and in doing so have adopted a view of morality that is totally alien to Western Culture.

  1. to judge that rasulullah married a child because aisyah was only 6 when he married her is clearly looking into this issue from a very narrow perspective. the fact rasulullah married her when she was six, and lived under the same roof with her when she was 9 shows that rasulullah was giving tme for further maturity, somethg relevant to take into consideration. is an arabic girl at the age of nine has the same biological maturity as the nine year old girls we have today? note that the marriage happened more than 1000 years back, and growth of children today has been stunted by additives in fastfood and other environmental factor. for a father to marry off his child is rght according to the shariah. but there are guidelines to follow. the brdegroom must be of the same standard of education, social status, n beauty. giving the father an authority to marry off his child is probably bcoz the father can judge better, compared to his young child who would probably screw up life by marrying someone based on lust.

  2. Many problems with Islam today can be traced to the fact that the followers believe in the words and practices of the Prophet Muhammad exactly as they were in the 7th Century. Your argument says that a 9-year old child was more mature 1400 years ago than a 9-year old child of today yet you fail to acknowledge that the Fatwa mentioned was a modern day approval applicable to the same prepubescent children today that you say are less mature. If your argument is valid then you should be disagreeing with the Fatwa and not trying to justify the practice.

There is no evidence to support "anonymous's" contention that 1400 years ago 9 year olds were more physically or psychologically capable of handing sexual intercourse than 9 year olds today. 1400 years ago is only about 50 generations - that's 50 PEOPLE! I do not believe that human evolution has changed so much in such a short evolutionary period to grant adulthood to 9 year olds then and prepubescence to them now. That excuse for pedophilia (and that's what it was and is) is a very pathetic one at best. Muslims will do anything to excuse the inexcusable.
